4a. |
Subject to the Livery Owner’s obligations in clause 3 above, the Horse Owner shall be wholly responsible for the welfare of the Horse. In particular, the Horse Owner shall:- |

i. |
Feed the Horse and ensure that it has clean fresh water at all times; |
| |
|
ii. |
Maintain proper clean bedding for the Horse at all times; |
| |
|
iii. |
Regularly worm the Horse; |
|
| |
6a. |
The Livery Owner may serve notice on the Horse Owner increasing the Livery Fee. The notice must be in writing and of at least six weeks, to take effect on the day of the month on which the Livery Fee is due. The Livery Fee may not be increased during the first 12 months of the Livery Period, nor may it be increased more than once in any 12 month period thereafter. |

6b. |
The Horse Owner shall pay a deposit of £………on the execution of this Agreement, to be held by the Livery Owner as security for the performance of the obligations of the Horse Owner under this Agreement. |

a. |
The Livery Operator will maintain a policy of insurance with reputable insurers for building and contents in respect of the Premises (including the tack belonging to the Horse Owner), and public liability in respect of the livery business conducted at the Premises. |

b. |
The Horse Owner will maintain a policy with reputable insurers for public liability arising from damage caused by the Horse in connection with its presence and use at or from the Premises. |

|
|
| |
|
a. |
The Livery Operator shall summon a vet for the Horse whenever this is reasonably necessary. In this regard the Livery Operator shall act as agent for the Horse Owner, and shall not incur any personal liability for veterinary fees. |

|
b. |
The vet must be a member of the Royal College of Veterinary Surgeons, and must have experience in treating horses. |
| |
|
c. |
The Horse Owner shall pay all such veterinary fees on demand by the Livery Operator, in addition to the Livery Fee.. |

The Seller warrants that the said horse is sound, free from vice and fit for riding as (state nature and purpose for which the horse is bought e.g. jumping, hunting) save for….list known vices e.g. shies at tractors, or has permanent cough. |

If the said horse does not comply with the above warranty, the Buyer may return the said horse to the Seller not later than * * days from the date of this agreement, accompanied by a certificate from a qualified veterinary surgeon specifying the respect in which the horse does not so comply. |

The Owner agrees to lend the Horse and the Tack to the Borrower for the Loan Period free OR for £…. Per month payable in advance. |

The Borrower will keep the Horse at the Location upon the following conditions (state whether to be stabled or turned out). The Horse may not be kept anywhere else without the prior written permission of the Owner. |
